			<content:encoded><![CDATA[<p>From 1 October 2010, the Equality Act replaced most of the Disability Discrimination Act (DDA). However, the Disability Equality Duty in the DDA continues to apply. Find out about the protection and legal rights the Equality Act provides for disabled people.</p>
<h3>Equality Act 2010</h3>
<p>The Equality Act 2010 aims to protect disabled people and prevent disability discrimination. It provides legal rights for disabled people in the areas of:</p>
<ul>
<li>employment</li>
<li>education</li>
<li>access to goods, services and facilities including larger private clubs and land based transport services</li>
<li>buying and renting land or property</li>
<li>functions of public bodies, for example the issuing of licences</li>
</ul>
<p>The Equality Act also provides rights for people not to be directly discriminated against or harassed because they have an association with a disabled person. This can apply to a carer or parent of a disabled person. In addition, people must not be directly discriminated against or harassed because they are wrongly perceived to be disabled.</p>
<p>More information about the Equality Act, and how you can obtain copies of the Act, can be found on the Government Equalities Office website.</p>
<h3>The definition of ‘disability’ under the Equality Act 2010</h3>
<p>In the Act, a person has a disability if:</p>
<ul>
<li>they have a physical or mental impairment</li>
<li>the impairment has a substantial and long-term adverse effect on their ability to perform normal day-to-day activities</li>
</ul>
<p>For the purposes of the Act, these words have the following meanings:</p>
<ul>
<li>&#8216;substantial&#8217; means more than minor or trivial</li>
<li>&#8216;long-term&#8217; means that the effect of the impairment has lasted or is likely to last for at least twelve months (there are special rules covering recurring or fluctuating conditions)</li>
<li>&#8216;normal day-to-day activities&#8217; include everyday things like eating, washing, walking and going shopping</li>
</ul>
<p>People who have had a disability in the past that meets this defintion are also protected by the Act.</p>
<h4>Progressive conditions considered to be a disability</h4>
<p>There are additional provisions relating to people with progressive conditions. People with HIV, cancer or multiple sclerosis are protected by the Act from the point of diagnosis. People with some visual impairments are automatically deemed to be disabled.</p>
<h4>Conditions that are specifically excluded</h4>
<p>Some conditions are specifically excluded from being covered by the disability definition, such as a tendency to set fires or addictions to non–prescribed substances.</p>

<h3>Large items or permanent fixtures</h3>
<p>If you are physically disabled, and especially if you are a wheelchair user, you may need to get equipment and have permanent fixtures installed at home so that you can live there independently.</p>
<p>Examples of equipment and adaptations include:</p>

<li>stair lifts</li>
<li>ceiling hoists</li>
<li>powered or manual height-adjustable beds</li>
<li>powered leg-lifters for people who have difficulty lifting their legs into bed</li>
</ul>

<p>You may also need to have adaptation work done in your home &#8211; for example, having doorways widened or a ramp installed.</p>

<h3>Everyday items to make life easier</h3>
<p>A wide range of gadgets and devices are available that make everyday tasks easier for people with specific disabilities. Some examples are:</p>

<li>clamps and holders to keep jars stable so they can be opened with one hand</li>
<li>talking kitchen scales for people who are blind or visually impaired</li>
<li>alarm clocks that vibrate under the pillow for deaf and hearing impaired people</li>
<li>kettle tippers for people who have limited arm strength or restricted movement</li>
<li>devices that remind people with memory loss or learning disabilities to do a daily task, for example taking a pill</li>
</ul>

<p>You may have to pay for the equipment yourself. If a piece of equipment will meet a need the local council has assessed you as having, you can use your direct payments to pay for or towards it.</p>

			<content:encoded><![CDATA[<p>Just occasionally, I have an encounter with somebody that takes my<br />
breath away. Usually, it&#8217;s my colleagues here in the Independent Living<br />
offices who get to share it, but this one was such an egregious<br />
example, I thought I&#8217;d tell you too!</p>
<p>We have a subscriber (they had better remain nameless), a significant<br />
multinational organisation that has been with us for eight years, and<br />
whose sales director has told me on more than one occasion that we give<br />
them more sales leads than any other medium.</p>
<p>With their annual contract approaching renewal, I spoke today with<br />
their relatively new (five months or so) marketing manager. When I<br />
asked her if she wanted to continue with their page, she eventually<br />
admitted that she had never actually visited the site. I do wonder what<br />
&#8220;marketing&#8221; incorporates, if being familiar with the media that provide<br />
sales leads is not part of the remit?</p>
<p>I have now chalked up half a century in advertising and marketing, and<br />
sadly have come to the conclusion that the title of marketing, whatever<br />
the rank, is scattered about with considerably too much abandon!</p>
